Paid tiers are billed through our payment processor (Stripe). Metered usage is billed per the pricing shown at purchase. You are responsible for charges incurred under your account. Except where required by law, fees are non-refundable.
You agree not to scrape, resell, redistribute, or reverse-engineer the service or its data; not to overload or attack the service; and not to use it for any unlawful purpose. We may suspend or terminate access for violations.
The Shapira Max Bid Formula, analytics, compilations, software, and site content are our proprietary property. Public-record data underlying our analysis remains public; our compilation and analysis do not.
THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY LAW, EVEREST CAPITAL USA AND ITS AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS ARISING FROM YOUR USE OF, OR RELIANCE ON, THE SERVICE OR ITS DATA — INCLUDING ANY BIDDING DECISION OR AUCTION OUTCOME. OUR TOTAL LIABILITY WILL NOT EXCEED THE AMOUNTS YOU PAID US IN THE 3 MONTHS PRECEDING THE CLAIM.
You agree to indemnify and hold harmless Everest Capital USA from claims arising out of your use of the service or your auction activity.
These Terms are governed by the laws of the State of Florida. Venue for any dispute lies in the state or federal courts located in Brevard County, Florida.
We may update these Terms; continued use after changes constitutes acceptance.
